Teilnahmebedingungen

Die Teilnahme am Gewinnspiel von VAUEN GmbH, nachfolgend Betreiber oder Veranstalter genannt, ist kostenlos und richtet sich ausschließlich nach diesen Teilnahmebedingungen.
Ablauf des Gewinnspiels
Die Dauer des Gewinnspiels erstreckt sich vom 07. bis 31.10.2025. Innerhalb dieses Zeitraums erhalten Nutzer online die Möglichkeit, am Gewinnspiel teilzunehmen.
Teilnahme
Um am Gewinnspiel teilzunehmen, sind folgende Bedingungen notwendig:
* Teilnahme ab 18 Jahren, Wohnsitz im deutschsprachigen Raum
* Teilnahme über zwei Kanäle möglich: per email, indem der QR-Codes gescannt wird oder via Instagram: folge @vauen_pipes, like und teile Freund in den Kommentaren.
* Das Gewinnspiel endet am 31.10.2025 um 23:59 Uhr.
* Pro Person ist nur eine Teilnahme möglich. Doppelte Teilnehmende werden vom gesamten Gewinnspiel ausgeschlossen.
* Der Rechtsweg ist ausgeschlossen.
Die Teilnahme am Gewinnspiel ist kostenlos.
Teilnahmeberechtigte
Teilnahmeberechtigt sind natürliche Personen und das 18. Lebensjahr vollendet haben. Die Teilnahme ist nicht auf Kunden des Veranstalters beschränkt und nicht vom Erwerb einer Ware oder Dienstleistung abhängig.
Sollte ein Teilnehmer in seiner Geschäftsfähigkeit eingeschränkt sein, bedarf es der Einwilligung seines gesetzlichen Vertreters.
Nicht teilnahmeberechtigt am Gewinnspiel sind alle an der Konzeption und Umsetzung des Gewinnspiels beteiligte Personen und Mitarbeiter des Betreibers. Zudem behält sich der Betreiber vor, nach eigenem Ermessen Personen von der Teilnahme auszuschließen, wenn berechtigte Gründe vorliegen, beispielsweise
(a) bei Manipulationen im Zusammenhang mit Zugang zum oder Durchführung des Gewinnspiels, (b) bei Verstößen gegen diese Teilnahmebedingungen, (c) bei unlauterem Handeln oder (d) bei falschen oder irreführenden Angaben im Zusammenhang mit der Teilnahme an dem Gewinnspiel.
Gewinn, Benachrichtigung und Übermittlung des Gewinns
Zu gewinnen ist eine Auenland Merit Pfeife (glatt).
Die Ermittlung des Gewinners erfolgt nach Teilnahmeschluss und wird im Rahmen des Zufallsprinzips entschieden.
Der/die GewinnerIn der Verlosung wird zeitnah mittels einer email oder Kommentar unter dem Instagram Beitrag über den Gewinn informiert.
Die Aushändigung des Gewinns erfolgt ausschließlich an den Gewinner. Ein Umtausch, eine Selbstabholung sowie eine Barauszahlung des Gewinns sind nicht möglich.
Eventuell für den Versand der Gewinne anfallende Kosten übernimmt der Betreiber. Der Versand der Pfeife erfolgt durch DHL. Versand an eine Packstation ist nicht möglich. Mit der Inanspruchnahme des Gewinns verbundene Zusatzkosten gehen zu Lasten des Gewinners. Für eine etwaige Versteuerung oder Verzollung des Gewinns ist der Gewinner selbst verantwortlich.
Meldet sich der Gewinner nach zweifacher Aufforderung innerhalb einer Frist von 3 Wochen nicht, kann der Gewinn auf einen anderen Teilnehmer übertragen werden.
Beendigung des Gewinnspiels
Der Veranstalter behält sich ausdrücklich vor, das Gewinnspiel ohne vorherige Ankündigung und ohne Mitteilung von Gründen zu beenden. Dies gilt insbesondere für jegliche Gründe, die einen planmäßigen Ablauf des Gewinnspiels stören oder verhindern würden.
Datenschutz
Die Daten der Teilnehmer werden nur zur Gewinnermittlung gespeichert. Adressdaten werden nur von den Gewinnern erfasst und nur zum Versand des Gewinnes genutzt, diese Daten werden im Rahmen der gesetzlichen Aufbewahrungspflichten gespeichert. Den Teilnehmern stehen gesetzliche Auskunfts-, Änderungs- und Widerrufsrechte zu.
Eine über das Gewinnspiel hinausgehende Verwendung der Daten durch VAUEN erfolgt nicht, außer es wurde sich freiwillig beim Newsletter oder Prospektversand angemeldet.
Anwendbares Recht
Fragen oder Beanstandungen im Zusammenhang mit dem Gewinnspiel sind an den Betreiber zu richten. Kontaktmöglichkeiten finden sich im Impressumsbereich der Website.
Das Gewinnspiel des Betreibers unterliegt ausschließlich dem Recht der Bundesrepublik Deutschland. Der Rechtsweg ist ausgeschlossen.
Salvatorische Klausel
Sollte eine Bestimmung dieser Teilnahmebedingungen ganz oder teilweise unwirksam sein oder werden, so wird dadurch die Gültigkeit dieser Teilnahmebedingungen im Übrigen nicht berührt. Statt der unwirksamen Bestimmung gilt diejenige gesetzlich zulässige Regelung, die dem in der unwirksamen Bestimmung zum Ausdruck gekommenen Sinn und Zweck wirtschaftlich am nächsten kommt. Entsprechendes gilt für den Fall des Vorliegens einer Regelungslücke in diesen Teilnahmebedingungen.

Terms and Conditions of Participation in the Contest
Participation in the contest organized by VAUEN GmbH, hereinafter referred to as the operator or organizer, is free of charge and is governed exclusively by these terms and conditions.
Course of the Contest
The contest runs from October 7 to October 31, 2025. During this period, users will have the opportunity to participate online.
Participation
To enter the contest, the following conditions must be met:
- Participants must be at least 18 years old and reside in a German-speaking country.

- The contest ends on October 31, 2025 at 11:59 p.m.
- Only one entry per person is permitted. Duplicate entries will result in exclusion from the entire contest.
- Legal recourse is excluded.
Participation in the contest is free of charge.
Eligible participants
Eligible to participate are natural persons who have reached the age of 18. Participation is not limited to customers of the organizer and is not dependent on the purchase of a product or service.
If a participant’s legal capacity is restricted, the consent of their legal representative is required.
All persons involved in the conception and implementation of the contest and employees of the operator are not eligible to participate. Furthermore, the operator reserves the right, at its sole discretion, to exclude persons from participation if there are justified reasons, for example:
(a) in the event of manipulations in connection with access to or the execution of the contest,
(b) in the event of violations of these terms and conditions,
(c) in the event of unfair conduct, or
(d) in the event of false or misleading information in connection with participation in the contest.
Prize, notification and transfer of the prize
The prize is one Auenland “Merit” pipe (smooth).
The winner will be determined after the closing date in a random draw.
The winner of the prize draw will be notified promptly by email or comment under the Instagram post.
The prize will only be awarded to the winner. An exchange, personal collection or cash payout of the prize is not possible.
Any shipping costs incurred for the delivery of the prize will be covered by the operator. The prize will be shipped via DHL. Delivery to a parcel station is not possible. Additional costs associated with claiming the prize are the responsibility of the winner. Any taxation or customs duties on the prize are the sole responsibility of the winner.
If the winner does not respond within 3 weeks after two notifications, the prize may be transferred to another participant.
Termination of the Contest
The organizer expressly reserves the right to terminate the contest without prior notice and without giving reasons. This applies in particular if proper execution of the contest cannot be guaranteed for technical or legal reasons.
Data protection
The data of participants will be collected and stored for the purpose of determining the winner. Address data will only be collected from winners and used solely for shipping the prize. This data will be stored in accordance with statutory retention obligations. Participants have statutory rights of access, rectification and withdrawal.
No data will be used beyond the scope of the contest by VAUEN, unless a participant has voluntarily registered for the newsletter or catalogue mailing.
Applicable law
Questions or complaints in connection with the contest should be directed to the operator. Contact details can be found in the imprint section of the website.
The contest of the operator is subject exclusively to the law of the Federal Republic of Germany. Legal recourse is excluded.
Severability clause
Should any provision of these conditions of participation be or become invalid in whole or in part, this shall not affect the validity of the remaining provisions of these conditions of participation. The invalid provision shall be replaced by a legally permissible provision that comes as close as possible to the economic intent and purpose of the invalid provision. The same applies in the event of a loophole in these conditions of participation.
